Reg: Vindictive & wrongful Charge-sheets & Show Cause Memos served on 7000 Employees and Officers.
Ref: Our letter dated January 27, 2007
Further to our above letter on the subject demanding of the management to retrace their vindictive instructions and withdraw the charge-sheets and show cause memos, we observe that management is still going ahead with their illegal instructions. We once again wish to point out that we had given notice in advance to the management that all our members would participate in the strike action on 22nd January 2007 if management fails to resolve our issues amicably. Participation in strike action at the call of the Trade Union in pursuit of collective bargaining to resolve the demands and grievances is quite legal and legitimate right.
Hence management’s instruction and proposed action is untenable and illegal. Participation in strike action at the call of Trade Union is not a misconduct, rather it is an unalienable basic right. Hence to construe that participation in the strike is a misconduct is ill-conceived and mis-conceived. Further, when management did not and could not depute any one or make arrangements for taking the keys, issuing a charge sheet or show cause memo on this score does not arise.
Hence it is crystal clear that the proposed action of the management is malafide, illegal and provocative. In view of the wrongful instruction of the management to issue the charge sheet and show cause memo, please note that we have advised our members that since the management’s action is misplaced and hence need not be replied individually.
We once again demand of the management to withdraw the illegal and vindictive instruction.
